Mediation is a structured process where a neutral mediator helps separating couples resolve disputes, such as childcare arrangements and financial settlements. It promotes open communication and avoids court proceedings, saving time and money. Mediation ensures that both parties have a say in reaching fair and practical agreements.
Mediation outcomes are not automatically legally binding. However, agreements can be formalised into a legally binding consent order through the court. Mediators can guide you on the process to ensure childcare and financial arrangements are enforceable.
Mediation costs vary but start from £120 per hour per person. Costs are often lower than court fees. Legal Aid may cover mediation for those eligible, including the initial Mediation Information and Assessment Meeting (MIAM).
If mediation fails, you may need to apply to the court for a child arrangements order or financial order. Mediation is a required step before court, unless exempt, and the mediator will provide a signed MIAM form to proceed legally.
